Virginia Moves Closer to Legal Marijuana Sales After Years of Delays
Four days after Virginia senators narrowly approved legislation to establish the state's long-awaited recreational marijuana marketplace, a House subcommittee has unanimously voted to advance companion legislation that would finally bring legal cannabis sales to Richmond and across the Commonwealth.
The House General Laws subcommittee voted 7-0 on Friday, January 23rd to move forward with a measure filed by Delegate Paul Krizek (D) that closely mirrors Senate Bill 542, the comprehensive proposal approved by the Senate Rehabilitation and Social Services Committee in an 8-7 vote the same day.

When Will Marijuana Sales Start in Virginia?
Both bills would direct the Virginia Cannabis Control Authority to begin accepting applications for cultivation, processing, testing and retail licenses starting July 1, 2026, creating a pathway for commercial sales in a state where adults have been allowed to possess and grow marijuana since 2021—but have had nowhere legal to purchase it.
Timeline for Virginia Cannabis Retail:
- Now through June 2026: Legislative process continues
- July 1, 2026: License applications open (if bill passes)
- 2027: Earliest possible retail sales (exact date TBD)
Key Changes to Virginia Marijuana Laws in the 2026 Bills
Increased Possession Limits
The House bill, like its Senate counterpart, would increase the legal possession limit for adults 21 and older from one ounce to 2.5 ounces and substantially rewrite Virginia's marijuana criminal code to align with the new regulatory framework.
New Criminal Penalties for Unlicensed Cannabis Activity
Under the proposed changes:
- Cultivating or processing without a license: Class 6 felony
- Unlicensed sales: Starts as a misdemeanor, escalates with repeat violations
- Selling to minors: Remains a Class 1 misdemeanor
Reduced Penalties for Past Marijuana Offenses
At the same time, several existing felony provisions would be reduced or eliminated, including:
- Penalties for transporting large quantities into Virginia
- Certain sentencing enhancements that previously grouped marijuana with harder controlled substances
What This Means for Richmond Cannabis Consumers
"We've been stuck in this gray area for nearly five years," said one supporter of the legislation. "It's time to finish what we started."
The current legal landscape in Virginia has created confusion. Adults can:
- Possess up to 1 ounce of marijuana (potentially 2.5 oz if new bill passes)
- Grow up to 4 plants at home
- Give marijuana to other adults (not sell)
But adults cannot:
- Purchase marijuana legally from any retail store
- Buy from licensed dispensaries (medical program only)
This has led to a proliferation of unlicensed shops and gray-market hemp products across Richmond and Virginia.
Governor Spanberger Supports Marijuana Sales Legalization
The parallel advancement of both measures signals growing momentum for marijuana legalization in Richmond under newly sworn-in Governor Abigail Spanberger (D), who has voiced support for establishing a regulated market.
The legislation addresses concerns raised by the governor about the confusion and public safety risks created by the current legal limbo.
Virginia's History with Marijuana Legalization
Virginia became the first southern state to legalize adult cannabis possession in 2021, but efforts to launch retail sales were repeatedly blocked by former Governor Glenn Youngkin (R), who vetoed similar legislation twice.
Why Virginia Hasn't Had Legal Marijuana Sales Yet
Despite legalizing possession nearly five years ago, Virginia has been stuck in a unique situation:
- 2021: Possession and home cultivation legalized
- 2021-2024: Governor Youngkin blocked retail sales bills
- 2025: New pro-reform governor takes office
- 2026: Fresh push for retail framework
What Happens Next for Virginia Cannabis Legalization
With both chambers now moving forward on the issue, lawmakers appear poised to finally deliver on the commercial marketplace that voters and advocates have sought for years. However, the bills still face:
- Additional committee votes in both chambers
- Floor debates in the House and Senate
- Reconciliation if versions differ
- Final signature from Governor Spanberger
The House bill now advances alongside the Senate version as the 2026 legislative session continues.
